More dispute erupts over 12th Man Trademark

Unauthorized use of the Texas A&M 12th Man Trademark has resurfaced, this time by Yahoo!, a company that provides an Internet search engine for business and personal use.

Yahoo! has a section on its Web site for World Cup Soccer fans, and within this section is a 12th Man link that provides interactive Web use for fans to get more involved.

Representatives from the University discovered the unauthorized trademark use sometime within the past two weeks, said Lane Stephenson, deputy director of University Relations. A&M sent a cease and desist letter to Yahoo! asking the Web site to stop using the 12th Man reference, Stephenson said.

"The University has been made aware of Yahoo!'s use of the 12th Man Trademark and forwarded a letter to stop its use," Stephenson said. "This is the first step in the process. If Yahoo! does not stop, the University will take additional steps."

This is the second time in 2006 the 12th Man Trademark has been used, the first time being by the Seattle Seahawks.

A&M and the Seattle Seahawks reached an agreement in May that will allow the Seahawks a limited license to use the trademark within its seven-state broadcast region, according to a news release issued by Steven Moore, vice president of communications and chief marketing officer.
